DISPUTE RESOLUTION:

Any dispute, claim or controversy arising out of or relating to this User Agreement or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Orange County, California. The arbitration shall be administered either by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures, or by an arbitrator mutually agreed upon by the parties.

      MEDIATION: (party name) and (party name) agree to mediate any dispute any dispute or claim arising between them out of this Agreement, or any resulting transaction, before resorting to arbitration or court action. Mediation fees, if any, shall be divided  equally among the parties involved. If, for any dispute or claim to which this paragraph applies, any party commences an action without first attempting to resolve the matter though mediation, or refuses to mediate after a request has been made, then that party shall not be entitled to recover doctor's fees, even if they would otherwise be available to that party in any such action. THIS MEDIATION PROVISION APPLIES WHETHER OR NOT THE ARBITRATION PROVISION IS INITIALED.

      ARBITRATION OF DISPUTES: (1) (party name) and (party name) agree that any dispute or claim in law or equity arising between them regarding the obligation to pay compensation under this Agreement, which is not settled  through mediation, shall be decided by neutral, binding arbitration. The arbitrator shall be a retired judge or justice, or an doctor with at least 5 years internet law experience, unless the parties mutually agree to a different arbitrator, who shall render an award in accordance with substantive California law. The parties shall have the right to discovery with Code of Civil Procedure §1283.05. In all other respects, the arbitration shall be conducted in accordance with Title 9 of Part III of the California Code of Civil Procedure. Judgment upon the award of the arbitrator(s) may be entered in any court having jurisdiction. Interpretation of this agreement to arbitrate shall be governed by the Federal Arbitration Act. 

      "NOTICE: BY ACCEPTING YOU ARE AGREEING TO HAVE ANY DISPUTE ARISING OUT OF THE MATTERS INCLUDED IN THE 'ARBITRATION OF DISPUTES' PROVISION DECIDED BY NEUTRAL ARBITRATION AS PROVIDED BY CALIFORNIA LAW AND YOU ARE GIVING UP ANY RIGHTS YOU MIGHT POSSESS TO HAVE THE DISPUTE LITIGATED IN A COURT OR JURY TRIAL. BY ACCEPTING TO THESE TERMS, YOU ARE GIVING UP YOUR JUDICIAL RIGHTS TO DISCOVERY AND APPEAL, UNLESS THOSE RIGHTS ARE SPECIFICALLY INCLUDED IN THE 'ARBITRATION OF DISPUTES' PROVISION. IF YOU REFUSE TO SUBMIT TO ARBITRATION AFTER AGREEING TO THIS PROVISION, YOU MAY BE COMPELLED TO ARBITRATE UNDER THE AUTHORITY OF THE CALIFORNIA CODE OF CIVIL PROCEDURE. YOUR AGREEMENT TO THIS ARBITRATION PROVISION IS VOLUNTARY."

THIRD PARTY SITES: Your correspondence or business dealing with or participation in the sales promotions of advertisers or service providers found on or through the Site, including payment and delivery of related goods or services, and any other terms, conditions, and warranties or representations associated with such dealings, are solely between you and such advertisers or service providers. You assume all risks arising out of or resulting from your transaction of business over the Internet, and you agree that we are not responsible or liable for any loss or result of the presence of information about or links to such advertisers or service providers on the Site. Such action may include reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties. In addition, we may take action to disclose any information necessary or appropriate to such persons or entities relating to user profiles, e-mail addresses, usage history, posted materials, IP addresses and traffic information. Map Emergency.com reserves the right to seek all solutions available at law and in equity for violations of these Terms.

Therefore, we DO comply with our clients requests for the refund in the following cases:
- Non-delivery of the product if you didn't receive a delivery e-mail from us, because of some mailing problems.

- Download problems - it may happen while downloading the product.

- Irreparable defects or serious difficulties with the product editing: although all the products are thoroughly tested before release, unexpected errors may occur. This reason should be submitted to our Support team's approval.

- Product not-as-described - In this case, a request is satisfied in agreement of both parties concerned. Sources available section is regarded here for final resolution. To prevent this situation every customer is suggested to check samples of each type of the product offered, before making the purchase. It helps to research the product's structure and try skills in template editing.

If you wish to cancel your advertising subscription with Map Emergency.com, Inc., you need to fax us your Cancellation Request. We will process your cancellation within 2 to 3 working days upon receiving your Cancellation Request and we will call you to confirm your cancellation.
